If the debtor can establish that there is a genuine dispute, it will be able to apply for (and will almost certainly get) an injunction preventing you from proceeding with the petition. Worse still, you will also be responsible for the costs that the debtor incurs in getting the injunction. Therefore, it is vital that there is no chance of the debtor being able to manufacture a dispute to disrupt the process. |
